Policy of APPLAY-MARIN LLC regarding the processing of personal data

1. This document has been developed in accordance with the Federal Law of 27.07.2006 No. 152-FZ "On Personal Data" and defines the policy of Apply-Marine LLC regarding the processing of personal data provided to Apply-Marine LLC by personal data subjects for the purpose of providing employment services to citizens of the Russian Federation outside the territory of the Russian Federation. At the same time, the Policy of Apply-Marine LLC regarding the processing of personal data applies to all actions related to the processing of personal data on the website https://apply-marine.ru (hereinafter referred to as the Website) located on the Internet information network.

2. The purpose of processing personal data is the exercise of the powers of Apply-Marine LLC to organize the provision of employment services for citizens of the Russian Federation outside the territory of the Russian Federation, and other purposes related to the implementation of the activities of Apply-Marine LLC.

3. The legal basis for the processing of personal data are agreements concluded between the operator and the subject of personal data, consent to the processing of personal data, compliance with the requirements of the Federal Law of 27.07.2006 No. 152-FZ "On Personal Data", as well as other legal acts that regulate relations related to the activities of the operator.

4. The content and volume of processed personal data must correspond to the stated purposes of processing.
The list of processed personal data, including biometric personal data, may contain the following personal data:
— last name, first name, patronymic (including previous ones), date and place of birth;
— passport data or data from another document certifying the identity of the subject of personal data;
— address of residence (according to passport and actual) and date of registration at the place of residence or at the place of stay;
— information about family composition;
— passport details of the parents (legal representatives) of the subject of personal data;
— information about education (series, number, date of issue of the diploma, certificate, diploma or other document on completion of an educational institution, name and location of the educational institution, date of commencement and completion of training and other information);
— information from compulsory (voluntary) medical insurance policies;
— information about health status;
— other information containing personal data necessary for the provision of employment services;
— other information that, taking into account the specifics of the work and in accordance with the legislation of the Russian Federation, must be presented by the subject of personal data upon conclusion of an employment contract or during its validity period.

5. The subjects of personal data processed by Apply-Marine LLC are employees of Apply-Marine LLC, users of the Site, citizens of the Russian Federation, their legal representatives, legal representatives of employers/ship owners, buyers/customers and recipients of goods/services (if the buyer/customer has indicated another person as the recipient of goods/services); any other individuals applying to Apply-Marine LLC with applications/requests.

6. Key concepts used in the Policy:
• personal data – any information relating to a directly or indirectly identified or identifiable individual (subject of personal data);
• personal data operator (operator) – Apply-Marine LLC, independently or jointly with other persons, organizing and (or) carrying out the processing of personal data, as well as determining the purposes of processing personal data, the composition of personal data subject to processing, actions (operations) performed with personal data;
• processing of personal data – any action (operation) or set of actions (operations) with personal data, performed using automation tools or without their use. Processing of personal data includes, among other things: collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction.
• automated processing of personal data – processing of personal data using computer technology;
• dissemination of personal data – actions aimed at disclosing personal data to an indefinite number of persons;
• provision of personal data – actions aimed at disclosing personal data to a specific person or a specific group of persons;
• blocking of personal data – temporary cessation of processing of personal data (except in cases where processing is necessary to clarify personal data);
• destruction of personal data – actions as a result of which it becomes impossible to restore the content of personal data in the personal data information system and (or) as a result of which the material carriers of personal data are destroyed;
• depersonalization of personal data – actions as a result of which it becomes impossible to determine the ownership of personal data by a specific subject of personal data without the use of additional information;
• personal data information system – a set of personal data contained in databases and the information technologies and technical means that ensure their processing;
• cross-border transfer of personal data – transfer of personal data to the territory of a foreign state to a foreign government body, a foreign individual or a foreign legal entity.
Security of personal data means the protection of personal data from unauthorized and/or unauthorized access to them, destruction, modification, blocking, copying, provision, distribution of personal data, as well as from other illegal actions in relation to personal data.

7. The processing of personal data is carried out only with the consent of the subject of personal data, expressed in any form that allows confirmation of the fact of receipt of consent, including in the manner provided on the Site, specified in paragraph 1 of this Policy.

8. When processing personal data, Apply-Marine LLC adheres to the following principles: personal data is processed on a lawful basis; personal data is not disclosed to third parties and is not distributed without the consent of the personal data subject, except in cases stipulated by the legislation of the Russian Federation; specific legitimate purposes are defined before the processing (including collection) of personal data; the combination of databases, including databases containing personal data, the processing of which is carried out for purposes incompatible with each other, is not allowed; the processing of personal data is limited to the achievement of specific, predetermined and legitimate purposes; the processed personal data are subject to destruction or depersonalization upon withdrawal of consent to their processing by the personal data subject, upon achievement of the processing purposes or in the event of loss of need to achieve these purposes, unless otherwise provided by federal law; the content and volume of the processed personal data correspond to the stated processing purposes.

9. The personal data being processed are not excessive in relation to the stated purposes of processing; when processing personal data, the accuracy of the personal data and their sufficiency are ensured, and, where necessary, the relevance of the personal data in relation to the stated purposes of their processing.

10. LLC "Apply-Marine" has the right to transfer personal data to third parties with the consent of the subject of personal data, as well as in cases where the possibility of transferring personal data to third parties is directly provided for by the legislation of the Russian Federation and does not require the consent of the subject of personal data.

11. The subject of personal data, whose personal data are processed by Apply-Marine LLC, has the right to: at any time change (update, supplement) the personal data provided by them by logging into the Personal Account in cases where the functionality of the Site allows it; delete the personal data provided by them by sending Apply-Marine LLC a written notice indicating the personal data that must be deleted; receive from Apply-Marine LLC: confirmation of the fact of personal data processing and information on the availability of personal data related to the relevant subject of personal data; information on the legal grounds and purposes of personal data processing; information on the methods of personal data processing used by Apply-Marine LLC; information on the name and location of Apply-Marine LLC; information on persons (except for employees of Apply-Marine LLC) who have access to personal data or to whom personal data may be disclosed on the basis of an agreement with Apply-Marine LLC or in accordance with the legislation of the Russian Federation; information on the terms of processing personal data, including the terms of their storage; information on the procedure for the exercise by the subject of personal data of the rights stipulated by the legislation on personal data; other information stipulated by the Law; demand the elimination of illegal actions of Apply-Marine LLC in relation to his personal data; revoke his consent to the processing of personal data at any time by sending an electronic message with an electronic signature to the email address: main@apply-marine.ru or by sending a written notice to the address: 353905, Krasnodar Krai, Novorossiysk, Engelsa St., 74/84. Upon receipt of such a notice, the processing of the personal data of the subject of personal data will be terminated, and his personal data will be deleted, except for cases where processing can be continued in accordance with the legislation of the Russian Federation. In this case, sending such a notice of revocation of consent by the subject of personal data shall also be considered a notice of unilateral refusal to fulfill the relevant order and shall entail the impossibility of its execution.

12. In accordance with the requirements of the legislation of the Russian Federation, Apply-Marine LLC is obliged to: provide the personal data subject, upon his request, with information concerning the processing of his personal data, or, on legal grounds, refuse within thirty days from the date of receipt of the request of the personal data subject or his representative; at the request of the personal data subject, clarify, block or delete the personal data being processed if the personal data are incomplete, outdated, inaccurate, illegally obtained or are not necessary for the stated purpose of processing, within a period not exceeding seven working days from the date of provision by the personal data subject or his representative of information confirming these facts; in the event of the personal data subject's withdrawal of consent to the processing of his personal data, stop the processing of personal data and destroy the personal data within a period not exceeding thirty days from the date of receipt of the said withdrawal, unless otherwise provided by the agreement between Apply-Marine LLC and the personal data subject. Apply-Marine LLC is obliged to notify the personal data subject of the destruction of personal data; perform other duties stipulated by Federal Law No. 152-FZ of July 27, 2006 and regulatory legal acts adopted in accordance with it.

13. When processing personal data, Apply-Marine LLC takes the necessary legal, organizational and technical measures to protect personal data from unauthorized and (or) unauthorized access to them, destruction, modification, blocking, copying, provision, distribution of personal data, as well as from other illegal actions in relation to personal data. At the same time, ensuring the security of personal data is achieved by applying the measures provided for in Art. 19 of the Federal Law of 27.07.2006 No. 152-FZ "On Personal Data".

14. Subjects of personal data whose personal data are processed by Apply-Marine LLC may obtain clarification on the processing of their personal data by personally contacting Apply-Marine LLC or by sending a corresponding written request to the e-mail address: main@apply-marine.ru or by sending a written request to the address: 353905, Krasnodar Krai, Novorossiysk, Engelsa St., 74/84.

15. Employees of Apply-Marine LLC who, in connection with the performance of their official functions, became aware of the personal data of personal data subjects, are warned of possible disciplinary, administrative, civil or criminal liability in the event of a violation of the requirements of the current legislation governing the rules for the processing and protection of personal data.

16. Apply-Marine LLC may periodically make changes to this Policy, including to reflect changes in the scope of services provided by Apply-Marine LLC or changes in the functionality of the Site, as well as changes in legislation. A new version of the above provisions of the Policy shall enter into force from the moment of its approval by order of the General Director of Apply-Marine LLC, unless another date for its entry into force is specified in it.
